I do not want to say more, but the police will not decline to press charges, and the proper check and balance is the statutes and the courts.
if there is a dead body, a homicide, there is no way, it will not move up the chain of command and head towards the courts, the final destination.
If Actus reus and Mens Rea if found for murder, it will be so, if not then partial defences will lessen the conviction downwards.
I don't want to go into penal code and other things, but crimes of passion are not always accepted in the court and never excused.
