Martial arts instructor charged with rape of student - Jan 13, 2011

HE was the instructor of the martial arts club in a secondary school, & she, a Secondary 1 student, was a new club member.

A month aft she joined the club, the 41-year-old married father of 2 asked the 13-year-old 2 be his galfriend.

They becom physically intimate & had sex in his car. They even went 2 a temple 2 solemnise their 'marriage', & addressed each other as lao gong (husband in Mandarin) and lao po (wife).

All this was related by prosecutors in the High Court yesterday, the 1st day of the man's trial on 3 counts of statutory rape & 4 counts of sexual exploitation.

The alleged offences took place between February 2007 & May 2007.

The man, now 45, is denying the allegations. He is defended by Mr Martin Decruz, & will rely on a home video shot by 1 of his disciples as an alibi 4 2 of the charges.


Statutory Rape
sexual intercourse with a female below the legal age of consent but abv the age of a child, even if the female gave her consent, did not resist &/or mutually participated.
In all but 3 states the age of consent is 18, & the age above which the female is no longer a child varies, although 14 is common.
The theory of statutory rape is tat the girl is incapable of giving consent, although marriage with a parent's consent is possible.
Intercourse with a female child (below 16 or whatever the state law provides) is rape, which is a felony.

Its statutory rape, so the case is gone as long as prosecution can prove that he fucked her even once. Why did the AG charge him more than 3 years later ?
There could be some evidence tat could prove tat he had commited statutory rape 3 years ago.

Whether the gal is slut or not 4 tis case,i think is secondary.

I think few yrs ago, it is being confirmed by many countries, below 18yrs age are minors. Personally say, this MA instructor had film the willing partner and, she sign a concern form. It is worthless in court of laws.

She is a child, nothing else matters a case which, i guess all lawyers are happy to present in court. Maybe? Many such cases, the victims willing or by force, parents had load the complaints to school. The schools would advice the parents to seek law and orders.

It might not get complicated if, say both married, as i had ex army friends which had wife below the concern age. Both side parents had to sign the don't know what forms. I think the process is deal in family court, not in ROM also not sure, is this family court is being change to what name. That was more then 20 yrs ago.

Even if there are no statutory rape laws in Sg, a grown man having a sexual or romantic relationship with a 13-yo girl is just questionable on many levels.

But it seems like many of the guys here would either do it themselves or condone such behaviour.

After reading soo much on the latest rape trials and cases that had happened, it really brings back some of my personal encounter donkey years ago.....

Can i wrote, AG in the man in the streets term is called, gov lawyers? I am not too sure, guessing that 40yrs of history they have won 99% of the cases. I put the shoes in the lawyers side, not the victims so on.

I am confuse many yrs watching HK and Hollywood, including this country, "The pupil" what not, many cases won by the pte lawyers. The we engage kind, maybe it works for another country.

Hope i am not to powerful to write, if M Jackson who was also a big star here, his doctor cannot escape the net of law. Over there, he walked away free. Somethings it is the opposite, here is strict another place is relax, many lope holes to fill.

reading this type of stories just brings a chill down my spine as i had a very close shave when i was much younger.

When i 1st came out to work after my army, i joined a hotel and they had a chalet/bbq. there were lots of chicks around, even some of them were attached they were flirting around like nobody business. i remember after the bbq that nite, those that had to go back for their shift duty left for work and there were only afew of us, about 5-6 of us boys and gals left. we all went to sleep on the beds sharing 2 to a bed. Any sexual contact with a minor is a serious crime and should always be treated as such. I cannot understand these despicable teachers. It just keeps happening over and over again. It completely baffles me. These teachers...opps...I mean child molesters should be in prison and when they are released from prison, when they are done serving their time, they should never be allowed to teach again and have contact with children. They are child molesters! Not teachers!

IMHO, She was a minor when it happened. Until she is of legal age of consent, she was a minor which means the teacher or "instructor", THE ADULT, is the responsible one and must know better. At all costs, the teacher is to blame and this society should not let them off the hook. It disgusts me that they do.

The statutory rape provisions in both the Penal Code (Section 375) and the Women's Charter (Section 140) apply only to FEMALES. One of the definitions of rape in the Penal code is having sexual intercourse with a woman under 14, regardless of consent.

Section 140 of the Women's Charter defines the offence of carnal intercourse with an underage female (a less severe punishment than rape) as having sex with a woman under 16, regardless of consent.

It translate as : Any despicable person should have sex with a statue (wood or stone) if he harbor any thought of sex with a minor if not he be facing 4-cement walls and becoming a cell pet !
